This Waiver of Liability, Assumption of Risk, and Indemnification Agreement (“Waiver”) is a legally binding document intended to protect MATCH PLAY RECREATIONAL PLAYGROUND L.L.C. (the “Company”), its employees, officers, contractors, affiliates, and assigns from liability and legal claims arising out of participation in recreational activities, including but not limited to mini-golf and related entertainment attractions offered at the Company’s premises located in Dubai, United Arab Emirates. By participating in any activity at the venue, the undersigned individual (the “Participant”) acknowledges full understanding and acceptance of the inherent risks involved and agrees to the following terms and conditions:

1. 1. ASSUMPTION OF RISK

   The Participant affirms that they fully comprehend and voluntarily assume all risks associated with participation in the Company’s activities. Such risks include, but are not limited to, physical injury, sprains, broken bones, head injuries, allergic reactions, light-induced discomfort, disorientation due to visual effects, and interaction with glow-in-the-dark props and structures that may present unexpected physical or visual challenges. Participant acknowledges that the facility utilizes special lighting (e.g., ultraviolet black lights), sound effects, themed obstacles, and environmental design elements that may cause sensory stimulation. These conditions may exacerbate pre-existing health conditions such as vertigo, epilepsy, asthma, or anxiety disorders. Participants should consult a medical professional before engaging in any physical activity if they are uncertain of their health status. Participant agrees that their presence and participation is entirely voluntary and undertaken at their own initiative. They confirm that they have not been coerced, misled, or induced to participate without due consideration of the associated risks.

2. 2. RELEASE AND INDEMNIFICATION

   To the fullest extent permitted by applicable UAE law, the Participant, for themselves and on behalf of their heirs, executors, administrators, personal representatives, successors, and assigns, hereby releases, discharges, and holds harmless MATCH PLAY RECREATIONAL PLAYGROUND L.L.C. and all of its employees, contractors, directors, and representatives from any and all claims, causes of action, demands, damages, or liabilities of any kind or nature—whether known or unknown—arising from or related to participation in the Company’s services, including but not limited to claims arising from negligence, omissions, equipment failure, unsafe conditions, or third-party actions. Furthermore, the Participant agrees to indemnify and defend the Company against any claim brought against it by a third party arising from the Participant’s conduct, actions, omissions, or failure to follow safety guidelines. This indemnification includes the payment of any legal fees, court costs, damages, and other related expenses incurred by the Company.

3. 3. MEDICAL CONSENT AND EMERGENCY AUTHORIZATION

   In the event of an injury, illness, or medical emergency, the Participant (or parent/guardian in the case of a minor) authorizes the Company and its staff to obtain or provide emergency medical treatment as deemed necessary, including but not limited to the administration of first aid, CPR, or calling of emergency services (ambulance, paramedics, etc.). Participant accepts financial responsibility for any treatment provided and agrees not to hold the Company liable for any complications resulting from the medical care provided in good faith.

4. 4. ACKNOWLEDGMENT OF UNDERSTANDING

   Participant certifies that they have read this Waiver carefully, fully understand its content, and voluntarily agree to its terms. The Participant further acknowledges that this document is intended to have legal effect and constitutes a legally enforceable release of liability under applicable law. By signing below (or electronically consenting during the booking process), the Participant agrees to be bound by the terms of this Waiver. Copies of this document are available upon request.
