TERMS & CONDITIONS

These Terms and Conditions ("Agreement") constitute a comprehensive, binding legal contract between you (the "User", "Guest", or "Customer") and MATCH PLAY RECREATIONAL PLAYGROUND L.L.C. (the "Company", "we", "our", or "us"). By accessing our digital platforms, including our website, booking engines, payment portals, mobile applications, and customer support systems, or by physically attending our facility located in Dubai, United Arab Emirates (the "Venue"), you agree to comply with the obligations outlined herein. This Agreement governs all present and future use of our services, whether online, offline, or in-person.

1. 1. ACCEPTANCE AND MODIFICATION OF TERMS

   1.1 Binding Agreement

   By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including any future modifications. If you do not agree to these terms, you must immediately cease all use of our services.

   1.2 Right to Amend

   The Company reserves the right to revise, modify, or update this Agreement at its sole discretion. Amendments shall take effect immediately upon being posted on our website. It is your responsibility to periodically review the Terms for changes. Continued use of our services after such changes shall constitute your unequivocal acceptance of the revised Agreement.

2. 2. ELIGIBILITY AND LEGAL CAPACITY

   2.1 Minimum Age Requirement

   To access or use our digital platforms and to engage in transactions, you must be at least 18 years of age or the legal age of majority in your jurisdiction. By agreeing to these Terms, you represent and warrant that you meet the eligibility criteria.

   2.2 Minors and Guardianship

   Minors under the age of 18 may only participate in on-site activities if accompanied and directly supervised by a parent or legal guardian, who accepts full legal and financial responsibility for the minor's actions, safety, and conduct while on the premises.

3. 3. PERMITTED USE AND CONDUCT

   3.1 Lawful Use Only

   You agree to use our website and services solely for lawful purposes and in compliance with all applicable local, federal, and international laws, including data protection, consumer protection, and intellectual property regulations.

   3.2 Prohibited Activities

   Bookings can be made through our website, mobile application, or directly at the Venue. All bookings are subject to confirmation and availability.

   You agree not to:

   • Engage in any activity that may damage, disrupt, or interfere with our systems or other users' access.
   • Attempt to gain unauthorized access to our servers or data.
   • Use the platform to transmit harmful code, malware, or unsolicited promotional material.
   • Harass, impersonate, or abuse other users, staff, or third-party partners.

   Violation of this section may result in suspension or termination of your access and potential legal action.

4. 4. BOOKINGS, PAYMENTS, AND TRANSACTIONS

   4.1 Real-Time Availability

   All bookings are subject to availability at the time of request. The Company does not guarantee availability until payment has been received and a confirmation email issued

   4.2 Payment Obligations

   Full payment must be made via an accepted payment method (e.g., credit/debit card, online gateway or cash) at the time of booking. All charges are inclusive of applicable UAE VAT unless otherwise stated.

   4.3 Booking Confirmation

   You are responsible for reviewing your confirmation details for accuracy. Errors must be reported within 12 hours of booking.

   4.4 Booking & Cancellation Policy

   You acknowledge and agree to comply with the Company's Booking & Cancellation Policy, which forms part of this Agreement.

5. 5. INTELLECTUAL PROPERTY

   5.1 Ownership and Usage Rights

   All content, materials, and media presented on our platforms or at our venue—including but not limited to text, logos, brand names, slogans, photographs, designs, software, and layout—are the exclusive intellectual property of the Company or its licensors and are protected under UAE Federal Law No. 38 of 2021 on Copyrights and related rights.

   5.2 No Unauthorized Use

   No part of the content may be copied, distributed, modified, republished, uploaded, transmitted, or exploited for commercial purposes without our prior written consent. Unauthorized use may result in legal action and claims for damages.

6. 6. RISK DISCLAIMER AND LIMITATION OF LIABILITY

   6.1 Assumption of Risk

   By participating in any activity offered at the Venue, you acknowledge that such activities may carry inherent risks, including but not limited to minor injuries, falls, physical exertion, emotional stress, and other unexpected events. Participation is voluntary and undertaken at your own risk.

   6.2 Limitation of Liability

   To the maximum extent permitted by UAE law, the Company disclaims all liability for any direct, indirect, incidental, or consequential damages, injuries, losses, or claims arising from your use of the services, including but not limited to errors, delays, cancellations, or facility closures.

   6.3 Statutory Rights

   Nothing in this Agreement shall affect your non-waivable statutory rights under applicable UAE consumer protection laws.

7. 7. GOVERNING LAW AND JURISDICTION

   This Agreement and all matters arising from it shall be governed by the substantive laws of the United Arab Emirates. You hereby consent to the exclusive jurisdiction of the Courts of the Emirate of Dubai for the resolution of all disputes related to this Agreement or your use of our services.

8. 8. SEVERABILITY

   If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

9. 9. LANGUAGE AND INTERPRETATION

   These Terms may be translated into Arabic or other languages for convenience. In the event of a discrepancy, the English-language version shall prevail. Headings are provided for organizational purposes only and shall not affect the interpretation of this Agreement.
